O-15-16. Trust Deed.  Feb. 3, 1842.  Daniel S. Wilson conveys to Elias R. Wilson, a negro girl named Molsey, aged about 12 years, with her future increase, in trust for Daniel’s wife Charlotte L. C. Wilson, for her sole and separate use and not for any second husband.  Charlotte to have the power to devise to any child or children of Daniel and Charlotte.  Wit.  Saml. Woods, Saml. A. Woods.  Pr. Feb. 4, 1842.  Rec. Mar. 15, 1842.

 

O-39-41.  Marriage Settlement.  Mar. 25, 1842. Contemplating a marriage between Lucretia Ham and James W. Owens, Lucretia conveys certain property of hers to Thomas N. Hewitt, in trust for herself, her and her husband for their lifetimes, and their surviving children, etc.  The property consists of two negro slaves, Will and Letty, and the future increase of Letty, and Lucretia’s one ninth interest in the real estate devised by Stephen Morris to his wife A. Morris for her lifetime and after her death to his daughter Abba Ham and her heirs, of whom Lucretia is one. Schedule of Property.  Wit. Furney G. Ham, David J. Andrews, John S. Huggins.  Pr. O-54-56. Marriage Settlement.  June 30, 1842,  Contemplating a marriage between Mary Stephenson and William C. Brunson, certain property of Mary is conveyed to George W. McCall, in trust for Mary and William, their children, etc., including negro slaves Cloe, Thomas, Arnold and Emily.  Wit. Ervin B. Brunson, Jno. F. Ervin.  Pr. July 11, 1842.  Rec. July 11, 1842.

 

O-59-60. Mortgage. Mar. 31, 1842.  To secure a debt of $400 owed to Lewis McLendon, Thomas Gee conveys to McLendon a Negro man Ephram.  Ephram’s work until the debt is paid is considered as interest on the debt.  The conveyance is void if Gee pays the debt as agreed. Wit. Kinion McLendon, James McLendon.  Pr. July 12, 1842.  Rec. July 13, 1842.

 

O-67-70.  Marriage Settlement. May 28, 1842.  Contemplating a marriage between Alicia Middleton of Charleston and William Alexander Sparks of Society Hill, physician, Alicia’s residuary legacy in the negroes of the estate of her late father John Middleton of Charleston as indicated by hs will is conveyed in trust for her, Sparks and their children, to Gen. James Hamilton and Thomas Middleton.  “A more particular account” can be found in the inventory of the Negro Slaves of John Middleton’s estate.  The following table titled “Inventory of Slaves” is provided, arranged as here, apparently in columns on one page and then on a second and third pages:

O-72-3.  Trust Deed.  July 9, 1842.  Simon Parrott conveys to James A. Hodges of Lenoir Co., NC “who being now present in Darlington District,” in trust for his four grandchildren, children of James A. Hodges (namely Simon Edwards, Mary Penelope, James William and Louisa P. Hodges), the following Negroes now in possession of Hodges:  Susan, Emelia, Matilda, Fennett, Clara, Harritt (sic) and Ruth with their increase.  Grandchildren are to claim possession at the age of 21 or marriage.  In consideration for Hodges educating and maintaining the grandchildren and maintaining the Negroes, Parrott also conveys to James A. Hodges and his heirs a Negro girl named Zilpha, now in the possession of Hodges. Wit. Walter Kennedy, Jesse W. Parrott.  Pr. Aug. 20, 1842.  Rec. Aug. 20, 1842.

 

O-80.  Bill of Sale.  July 5, 1841.  Stephen Floyd Sr. of Sumter Dist. sells a Negro man John, aged 24 years, to Benjamin Smith, no price mentioned.  Wit. J[ohn]. E. Piggott, J. W. J. Floyd.  Pr. Nov. 6, 1841.  Rec. Nov. 7, 1842.

 

O-97-8. Mortgage.  Apr. 9, 1841.  To secure a debt of $8000, William E. Dargan conveys to George W. Dargan, negroes Peter, Tamar, Hubert and Emily.  If W. E. Dargan pays the debt, the conveyance is void.  Wit. Saml. J. Ervin.  Pr. Jan. 26, 1843. Rec. Jan. 26, 1843.

 

O-100-01.  Mortgage.  Jan. 1, 1843.  To secure two bonds guaranteeing the repayment of debts of $3000 and $2625, Neal McKay conveys and delivers to William E. James the following negroes, with their increase:  Pinckney, Moses, Jefferson, August, Ellison, old Rose, Caroline, young Rose, Caty, Jackson, Phillis, & child, Hannah, Hester, Julia, Emeline, Paris, Judy, Patsey, Eliza, Isaac, Friday, Zacky, Tilly, Mary & child, Silvey & two children, Dorky, as well as  several horses.  The conveyance is void if McKay pays as agreed.  Wit. O-107-09.  Trust Deed of Gift.  Feb. 7, 1843.  John N. Williams conveys to Boykin and John Witherspoon, in trust for Elizabeth B. DuBose, wife of Kimbro C. DuBose, sister of Boykin and John Witherspoon and sister-in-law of John N. Williams, the following slaves:  Frank, China, Sarah, Thomas, Binah, Dembo, Mark, London, Billa, Joe, Daniel, Toby, Mary, Mark, Anna, Violet, Winny, Jenney, Grandville, Baily, Mary, Charles, Jasper, Moses, Phillis, Creesy, Abraham, Dice, and Amanda. Kimbro C. DuBose is to have possession and profits for the support of himself and his family during the lifetime of Elizabeth B. DuBose. Extensive survivorship instructions follow.  Trustees may sell except for such house servants as Elizabeth may reserve for her own use.  Wit. William H. Evans, J. D. Witherspoon.  Pr. O-145-46.  Deed of Gift.  Apr. 1, 1843.  Mary Fountain conveys to her sons George Fountain, John Fountain and Thomas Fountain, negro slaves Anthony, Betty and Tab and other property which was left to her in the will dated Dec. 8, 1837 of her late husband Alexander Fountain. The property is to be divided as part of the residuary clause in the will.  Wit. O-148.  Deed of Gift.  Apr. 7, 1843.  John Garner conveys to his daughter Sarah Moselle Garner four negroes:  Isom, Jerry, Hubbard and Burrell, for her life and then to the heirs of her body.  If she has no issue, then to her sister Eliza Evaline Garner.  Negroes are to remain in the possession of John Garner until his death.  Wit. O-149.  Deed of Gift. Apr. 9, 1843.  John Garner conveys to his daughter Eliza Evaline Garner four negroes:  Needham, Evans, Frank and William, for her life and then to the heirs of her body.  If she has no issue, then to her sister Sarah Moselle Garner.  Negroes are to remain in the possession of John Garner until his death.  Wit.  James Anderson, John Haguewood.  Pr. O-195-96.  Trust Deed of Gift.  June 3, 1843.  William L. Moye conveys to George H. Moye, in trust for William’s daughter Sarah Ann L. Milling, wife of John J. Milling, and for her separate use and maintenance, various property including a negro woman Amy, aged about 27 years, and her two children Lydia, aged about 10, and Eliza, aged about 8 years.  Property is to descend to Sarah’s children, if any, and if not to return to the estate of William L. Cannon, negro slaves with their increase: Jerry, Jane, Missouri, Ned, Harriet and Tilman, in trust for the wife and children of Moye’s friend George P. Cannon, to the use and support of George P. Cannon’s wife Martha Cannon and their children Sarah Jane, Edmund R., Simeon O’N., Julius D., Josephine Caroline and Martha Ann Cannon, and any other child or children to be born to George and Martha.  Wit. O-209-10.  Trust Deed of Gift.  May 5, 1843.  Eliza Ann Miller conveys to John HA. Dixon two negro men, Will and Hubbard, in trust, for the sole and separate use of Eliza’s father Jonathan Miller during his lifetime and then Will is to be given up to Eliza’s sister Mary Jane Miller, as will be seen in another deed, and Hubbard is to be returned to Eliza or her estate.  Marginal note:  Delivered to S. O-210-11.  Deed of Gift.  May 4, 1843.  Eliza Ann Miller gives to her sister Mary Jane Miller four negroes with their increase:  woman Harriet, man Will, girl Lydia and boy Virgil, children of the woman Harriet. Will is reserved from this conveyance during the lifetime of Eliza’s father Jonathan Miller.  Wit.  Laura Crosswell, Saml. O-213-15.  Marriage Settlement.  Sept. 5, 1843.  Contemplating her marriage with Thomas B. Haynsworth, Elizabeth H. McCall conveys certain property, including a mulatto woman Virginia, to James S. McCall, in trust for her self, her and her husband, their issue if any, etc.  Schedule of Property.  Wit.  M. S. McCall, M. A. Baily.  Pr.  Nov. 21, 1843.  Rec. Nov. 21, 1843.

 


O-217-18.  Receipt and Certification. Aug. 28, 1843.  David Sparks states that he has received from his father Alexander Sparks certain property, including a plantation in Marlborough Co. called Helpfield or Roach old field, bought of D.R.W. McIver, and the following Negro slaves:  Ben and his wife Matilda and their three children, little Ben, Dorcas and Thadeus; Joe and his wife Rosanna, her daughter Jane and Frances and child; Jasper and his wife Harriet; Black Milly and her four children, Julia, Hiram, Dianna and an infant; Tempy and her three children, Amelia, Lucretia and an infant; Stepney and his wife Judy; Broady; Titus and his wife Becky; Edmund son of Simon; and Isaac Blacksmith. Title to this property remains in Alexander Sparks who may dispose of it by will at his pleasure.  If Alexander dies intestate, David is responsible for an accounting of it to the estate.  Wit. O-218-19.  Receipt and Certification.  Aug. 28, 1843.  William A. Sparks states that he has received from his father Alexander Sparks certain property, including the Ferry plantation in Marlborough Co. except a portion adjacent to the Helpfield or Roach old field plantation, and the lands near the ferry in Darlington Co., and the following negro slaves: Simon the ferryman and Lavenia his wife, their daughter Rose and her two children Mary and an infant; Ferriby a young woman; Lewis Scott, his wife Emily and their three children Wisdom, Dembo and Pompey; Morris, his wife Amy and their son Willis; Jim and his wife Fanny and their four children Washington, Martha, Suckey and Jemima; Will house servant; Charity and her daughter Nancy; Santee son of Milly; and Aaron.  Title to this property remains in Alexander Sparks who may dispose of it by will at his pleasure. If Alexander dies intestate, William is responsible for an accounting of it to the estate.  Wit. O-279.  Receipt and copy of extract from will.  Jan. 11, 1844.  Mary L. Wilkins and S. B. Wilkins acknowledge receipt of negroes from Evan Lide, trustee named in the will of S. V. King.  Copy of clause of will of S. V. King indicates that James Brown (who declined to serve) and Evan Lide are trustees to receive negro woman Sylvester “commonly [called] Ves” and her child Gadson and a negro boy Augustus, in trust for the use of his King’s sister Mary S. O-279-81.  Mortgage.  Feb. 6, 1844. To secure a bond or obligation owed to William Wingate in the amount of $3300, conditioned on the payment of a debt of $1650, George Huggins conveys to Wingate negro slaves Charlotte and her infant Lewis, Nero, Lenard, Tom, George, Princes [sic], Anna, Esther, Herod, Cate, Clara, Deanah and Nancy.  Conveyance is void if Huggins performs on his obligation.  Wit. O-281-82.  Trust Deed of Gift.  Feb. 22, 1844.  Mary Ann Blackwell conveys to John H. Blackwell, in trust for Mary Ann’s daughter Isabella Ann Wingate, wife of William Wingate, “a certain Negro Girl named Zilpha about Ten years of age of a yellow complection or what is commonly called a mulatto which said negro Girl Zilpha I lately purchased from the said William Wingate for the sum of Two hundred and seventy five Dollars,” with her future increase.  The conveyance is for the benefit of Isabella Ann and not in the control of her husband or any future husband, and then as disposed of by will or deed.  Wit.  Thos. Murphy coveys to Kelly a female slave named Candis, aged about 8 years. Conveyance is void if Murphy pays the debt as agreed.  Wit. Peter R. Mourey, W. H. Wingate.  Pr. Feb. 24, 1844.  Rec. O-288-89.  Deed of Gift.  Jan. 13, 1844.  William H. Cannon in his will bequeathed to Ann S. Cannon certain negro slaves Captain, Kizzy and her five children and her future increase, and Jennetta and her six children and her future increase, for her lifetime, with the right to give any of the slaves to Caroline Smith, with a reversion of the estate of William A. Cannon if Smith dies without issue.  Exercising that right, Ann S. Cannon conveys Kizzy and her future increase to Caroline Smith, retaining a reversionary interest to W.H. Cannon’s estate.  Wit.
